Notes on Johnnie and Hays Kile:
    The State of Texas

No. 558
County of Coleman     In the County Court of Coleman County, Texas.

To Honorable W Marcus Weatherred Judge of said Court.

Now comes L.V. Stockard your petitioner who resides in Coleman County, Texas and shows to the court;

     1--That Johnnie Kile is a boy minor of the age of eighteen years and that Hays Kile is a boy minor of the age of thirteen years and that each of said minors resides in Coleman County, Texas and that said minors are without any lawful guardian of their estates.

     2--That said minors are entitled to an estate of real property which is situated in the County of Coleman of the probable value of Twelve Hundred fifty and 00/100 ($1250.00) dollars.

     3--That the only surviving parent of said minors is their mother Della Campbell who resides in Coleman County Texas and that both of said minors reside in Coleman County, Texas and that the entire estate of said minors consists of One Half undivided interest in One Hundred and fifty acres of land in Coleman Counts Texas the other one half undivided interest being owned by the said Della Campbell.

     4--That said minors each own a one fourth undivided interest and the said Della Campbell a one half undivided interest in and to the one hundred and fifty acres of land in Coleman County Texas, described in a deed by T. M. Hays and wife Madie Hays to J.S. Kile the father of said minors and now deceased which said deed is dated November 2nd 1904 and is recorded in Vol 56 page 231 deed records Coleman County, Texas and said land is out of and a part of the Samuel Sprague survey No 659 which said land is described in said deed by metes and bounds as follows;

Beginning at the N.W. corner of Samuel Sprague survey No 659 at st md for which a P.O. vrs N 83 E 11 vrs and a do brs N 12 W 10 vrs Thence E 688 vrs to the N.E. corner of this tract and corner of a tract owned by R.F Caradine and out of said Samuel Sprague survey No 659 Thence S with W line of said Caradine tract to a corner in S line of said 659 and N line of Samuel Sprague survey No 660 Thence W 668 vrs with line between Nos 659 and 660 to a at xad in the E line of S.P.R.R.Co survey No 49 for S.E. corner of No 659 and N.W. cor of No 660 Thence N 1344 vrs with line between Nos 49 and 659 to place of beginning containing 163-8/10 acres less 10 acres owned by C.E.Brsnnon on N and of this tract and road ben on S end of this tract said tract containing 153 acres of land more or less.
     5--That said real estate has not been rented for the year 1916, and that same contains about 80 or 90 acres of tillable land suitable for cultivation and that it is for the interest of said minors that said land should be rented for the year 1916, and that the same contains a residence house and other such improvements as are necessary and suitable for the residence of a tenant and farmer and that a tenant can be procured for same at once who will rent said property for the year 1916, and will plant and cultivate and harvest come upon the usual and customary terms of one fourth of the cotton and one third of the seed stuff and that the said Della Campbell formerly Della Kile mother of said minors is desirious of procuring this guardianship for the purposes herein stated and is desirious and willing to join with your petitioner and making a rental contract of said premises for the year 1916. and that said Della Campbell desires your petitioner to be appointed, as such guardian and that unless a temporary guardianship of the estate of said minors is granted said minors and their said estate will suffer financial loss to the extent of the rental value for the year 1916, of said premises which will amount to approximately $250.00 to said minors.

     6--That your petitioner is in no way disqualified to receive letters of guardianship upon the estate of said minors and is the proper person to receive such letters and to act as guardian of the estate of said minors.

     7--Wherefore your petitioner prays the court that he be appointed temporary guardian of the estate of said minors and that he be authorized an such guardian in connection wit the said Della Campbell to rent and lease said premises for the year 1916, and to perform such other acts as may be proper and necessary In the premises and to execute a written contract of rental in connection with said lease and your petitioner further prays that notice of this application be given as required by law and that at the next term of this court that this temporaryappointment be made permanent and that your petitioner be made permanent guardian of the estate of said minors and that letters of guardianship as such be issued to him and for such other and further orders of the court as he may be entitled to in the premises.

Guardianship of the estate of In the County Court of Coleman County,Texas. Johnnie Kile et al, January term A.D. 1916.

On this the 26th day of January 1916, coming on to be heard and considered by the court the application of L.V.Stookard for letters of guardianship of the estate of Johnnie Kile and Hays Kile minors and it appearing to the court that said minors. have no lawful guardian of their estate and that the said L.V.Stockard is qualified to receive letters of guardianship and it appearing to the court that the saidJohnnie Kile and Hays Kile are minors and that the interest of said minorsand of their estate require the immediate appointment of a guardian of such an estate. It is therefore ordered by the court and by the judge thereof that the said L.V.Stockard be and he is hereby appointed guardian of the estate of said minors Johnnie Kile andHays Kile without citation and that due notice of said application be given and that said minors Johnnie Kile being over fourteen years of age shall be personally served with citation to appear and answer at the next regular term of this court as required and directed by law unless such minors by writing filed with the clerk of this court shall waive the issuance of such citation and it is further ordered that letter of guardianship of the estate of said minors issue to the said L.V.Stockard upon his giving bond In the sum of $500.00 payable and conditioned as required by law and taking the oath within twenty days and it is further ordered by the court and the judge thereof that such appointemnt of guardianship unless contested at the next regular term of this court after service of citation shall be made permanent.

And it is further ordered that the said L.V.Stockard after having qualified as such guardian shallbe and he Is hereby authorized in connection with Della Campbell to rent and lease for the year 1916, upon the usual terms the tracts. of about 150 acres. of land in the Samuel Sprague survey No 659 Coleman county Texas described in the petition of the applicant this day flied here in and he is hereby authorized to execute and deliver a written contract of rental for all the interest of said minors in and to said property.

It is further ordered that Leman Brown W.R.Kelley and Fred W Turner be and they are hereby appointed appraisers to make due appraisement of the estate of said minors and make return thereof to this court as provided by law.

That we L.V.Stockard as principal and the others subscribeds hereto as sure ties are held and firmly bound unto W. Marcus Weatherred County Judge of the County of Coleman and State of texas and his successors in office in the sum of Five Hundred ($500.00) dollars conditioned that the above bound who has been appointed by the County Court of Coleman County, guardian of estate of Johnnie Kile and Hays Kile minors will faithfully discharge the duties of guardian of the estate of the said minors according to law.
